Timeframe for submission of the Five-Year Census Statement (Bacen) starts in July

All companies with foreign participation in their share capital (in any amount) must file Five-Year Census Declaration before Brazilian Central Bank. The base year reference is 2020 and the base date reference is December 31st, 2020. The Five-Year Census is mandatory for years ending in 0 (zero) or 5 (five).

Through Normative Circular nº 3795/2016, Brazilian Central Bank conducts Foreign Capital in the Country Census to consolidate statistics on the external sector, that is, data on companies’ foreign investments and participation in the international share capital. Such statistics help, for example, in decision-making and the establishment of governmental strategies regarding economic policies, assisting economic researcher’s activities and international organizations.

What is the timeframe for submitting Census’ declaration? The regular timeframe for submitting is from 07/01/21 to 08/16/21 (until 6pm).

Who must respond to Census’ declaration? Entities and individuals who must respond to 2021 Five-Year Census - Base Year 2020:

• Legal entities headquartered in Brazil, with direct participation of non-residents in its share capital, in any amount, on the base date of December 31st, 2020;

• Investment funds with non-resident shareholders, on the base date of December 31st, 2020, through their managers; and

• Legal entities headquartered in Brazil, with total debit balance of short-term commercial credits (due within 360 days) granted by non-residents, in an amount equal to or greater than US$1 million, on the base date of December 31st, 2020.

Who is exempted from responding to the declaration? Entities and individuals who are exempted from responding to 2021 Five-Year Census - Base Year 2020:

• Private Individuals;

• Union Direct Administration’s bodies, States, Federal District and Municipalities;

• Legal entities indebted to foreign onlending credits granted by institutions headquartered in Brazil; and

• Non-profit entities supported by contributions from non-residents.
